ASHEVILLE The construe tion of segregated schools now Illegal, according to Federal Jude Wilson Warlick, who dismissed case In U.S. District Court here yesterday on that ground. Judge Warlick pointed the McDowell Board of Education could not legally build such school in his dismissal of sul brought against the board by group of Negro parents.

Judge Warlick said the U.S. Supreme Court ruling against sego regation in public schools made such a construction illegal. The parents, acting as "next friends" for their children, sought construction of a Negro school in Old Fort, which has none. Negro children there must be transported to Marion, leading the parents to claim their children lacked "'equal educational facilities" under the setup. Judge Warlick answered quest by the attorneys to amend the complaint by stating that grounds for such suit would only result from an express statement by McDowell school officials that Negro children would not be accepted in white schools.

McDowell School Superintendent Melvin H. Taylor did not comment on that possibility but said he feels "integration is inevitable." He said other McDowell school officials agreed with him and that "we expect to obey the law." South Carolina 32-A, Lions Interlatter's installation as president of retiring president (left), and R.
